Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Habeas Corpus directing the first respondent herein to produce the body of his minor daughter M.Lakshmi, aged 16 years (DOB 11.11.2003) before this Court from the illegal custody of the second respondent and hand over the custody to the petitioner/father.

We have heard Mr.R.Selvakumar, learned counsel for the petitioner and Mrs.Prabhavathi Ram, learned Additional Public Prosecutor appearing for respondents 1 and 3.

This habeas corpus petition has been filed by the petitioner - father to produce the detenue one M.Lakshmi - his minor daughter.

The learned Additional Public Prosecutor submits that

the minor girl has been secured. However, she is not willing to join her parents and hence, the respondent – police is producing her before the concerned Child Welfare Committee today.

Let the concerned Child Welfare Committee shall issue notice to the father of the petitioner, have a discussion with the petitioner and the minor girl and thereafter take appropriate action in the best interest of the minor.

With the above observation, the above habeas corpus petition is disposed of.
