Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 408, 409, 471, 477(A)IPC in Crime No.2 of 2019, on the file of the respondent police, seeks anticipatory bail.

3.The case of the prosecution is that an enquiry conducted under Section 81 of the Tamil Nadu Co-operative Societies Act, the petitioner, who is a Salesman, found guilty along with other https://hcservices.ecourts.gov.in/hcservices/ accused, for causing financial loss to the Society to the tune of

Rs.27,40,991/- which includes cash deficit and shortage of gold. Hence, the complaint.

4.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case.

5.The learned Government Advocate (criminal side) appearing for the State would submit that an enquiry conducted under Section 81 of the Tamil Nadu Co-operative Societies Act, the petitioner, who is a salesman, found guilty along with other accused, for causing financial loss to the Society to the tune of Rs.27,40,991/-. He would further submit that the investigation is in preliminary stage. He would also submit that the earlier bail application of the petitioner was dismissed only on 06.03.2020 and there is no change in circumstances. Hence, he prays for dismissal of the petition.

6.Considering the facts and circumstances of the case and also considering the misappropriation of huge amount to the tune of Rs.27,40,991/- involved in this case and the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner, at this stage. Hence, this petition is dismissed.
