PRAYER: This Criminal Original Petition has been filed under Section 482 of the Criminal Procedure Code to direct the respondent to produce the petitioner's Tipper lorry bearing Registration No.TN-41-Q-6210 seized by the respondent on 10.09.2019 along with connected records before the Principal Sessions Court, Salem.

This petition has been filed to direct the respondent to produce the Tipper lorry bearing Registration No. TN-41-Q-6210 before the Principal Sessions Court, Salem.

The learned counsel for the petitioner has submitted that the respondent has seized the petitioner's Tipper lorry bearing Registration No., TN-41-Q-6210, on 09.09.2019 at 09.00 P.M., alleging that the said lorry was used for transporting the river sand 3 ½ units. He further submitted that even though the respondent has seized the said vehicle on 09.09.2019, so far he has not produced the said vehicle before the concerned jurisdictional Magistrate and hence, the petitioner is not able to get interim custody of the said vehicle.

The learned Government Advocate has submitted that the respondent may be directed to produce the said vehicle before the concerned jurisdictional Magistrate.

Considering the aforesaid submission, the respondent is directed to produce the said vehicle before the jurisdictional Magistrate, within a week from the date of receipt of a copy of this order.
