Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition imposed by this Hon'ble Court by its order dated 27.09.2017 in Crl.MP(MD)No.8851/2017 in Crl.RC(MD)No.758/2017 directing us to appear before the Additional District and Sessions Judge, Ramanathapuram on the first working day of every month at 10.30 a.m. until further orders.

To allow this Criminal Revision and set aside the impugned Judgment of conviction and sentence passed by the Learned Additional District and Sessions Judge, Ramanathapuram dated 20.09.2017 in Criminal Appeal No.26 of 2013 delivered against the acquitting Judgment passed by the Learned Judicial Magistrate No.2, Ramanathapuram dated 16.03.2012 in C.C.No.91 of 2006.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.N.DILIP KUMAR, Advocate for the petitioners and of Mr.A.ROBINSON, Government Advocate (Crl.side) on behalf of the Respondent, the Court made the following order:-

The petitioners were granted suspension of sentence at the time https://hcservices.ecourts.gov.in/hcservices/ of admitting the revision case. They have been asked to appear before the Court below on the first working day of every month.

2.The petitioners' counsel states that the petitioners are based in Coimbatore and are senior citizens and it is very difficult for them to go to the jurisdictional Court which is at Ramanathapuram every month.

3.Taking note of the difficulties expressed by the petitioners'

counsel, the petitioners are directed to appear once in two months. But in the month, in which, the petitioners have been exempted from appearing before the Court below on the first working day, the petitioners shall appear before the Inspector of Police, CBCID, Coimbatore.

4.With this modification, this Miscellaneous Petition is partly allowed.
