When the matter came up on 06.10.2020, learned counsel appearing for appellants submitted that initially he has appeared for all the appellants, but, at present he is appearing only for appellants 1, 2 and 4 and papers were taken back by third appellant along with the change of vakalath. Learned counsel further submitted that the third appellant, in his evidence, has stated that he has no claim against the respondent/plaintiff. The third appellant was not present on that day. Hence, Registry was directed to print his name in the cause list and directed to list the matter today.

Even today, there is no representation for third appellant. Hence, this appeal is dismissed as against the third appellant.

Today, when the matter is taken up for hearing, learned counsel on either side submits that the matter has been settled between the parties.

Since the matter has been settled out of Court, the appeal is dismissed as settled out of Court. No costs.
