It cannot be denied that in view of the ever increasing population in the metros like Chennai, there is tremendous pressure, on the electricity supply, sewage system, water, etc. To ensure proper electricity, sewage etc., Government has to take measures, to expand the existing systems. Admittedly, pumping station is existing at Rajaraman Street, Kooturavu Nagar, Adambakkam. As per the petitioners, Government wants to expand the pumping station. Expansion of pumping station is itself is public interest. It is not for the Court, while exercising jurisdiction, under Article 226 of the Constitution of India, to decide as to whether the expansion of the pumping station is necessary or not. In view of the fact that population of the City is increasing, it cannot be said that expansion of the pumping station is not in public interest. Petitioner has not filed any document to substantiate that proper approval from the authorities has not been obtained. Merely, filing the lay out plan is not sufficient to establish that installation of the pumping station was not proper. In any event, pumping station is working and the functioning of the same has not been challenged. What is sought to be challenged is the expansion for the pumping station.
