This Second Appeal filed under Section 100 of C.P.C., against the judgment and decree dated 30.04.2009 passed in A.S. No.4 of 2002 on the file of the Sub Court, Ambasamudram, reversing the judgment and decree dated 13.12.2001 passed in O.S. No.73 of 1997 on the file of the Princial District Munsif Court, Ambasamudram.

This Second Appeal coming up for hearing on Friday the Twelfth day of July, Two thousand and Nineteen; upon perusing the grounds of Appeal, the judgments of the Lower Appellate Court and the Court of First Instance and the material papers in the Suit and upon hearing the arguments of Mr. V. Meenaksh Sundaram, Advocate for the Appellants and the Advocate for respondents 2 to 6 having filed a memo stating that there is no instriction from them, this Court while allowing this Second Appeal, doth order and decree as follows:-

(1) That the Judgment and Decree dated 30.04.2009 passed in A.S. No.4 of 2002 on the file of the Sub Court, Ambasamudram be and hereby are set aside, and this second appeal is allowed;

(2) That the judgment and decree dated 13.12.2001 passed in O.S. No.73 of 1997 on the file of the Princial District Munsif Court, Ambasamudram be and hereby are confirmed; and

(3) That there be no costs in this Second Appeal.
