PETITION FOR BAIL Under Sec. 439 Cr.P.C.
ORDER : The Court Made the following order :-
The petitioners, who were arrested and remanded to Judicial custody on 08.02.2019, for the alleged offence punishable under Sections 120 (b), 406, 420 & 506 (ii) IPC, in Crime No.4 of 2019, on the file of the respondent police, seek bail.
2.The case of the prosecution is that the petitioners are running a company in the name and style of 'Jeyam Wealth Agrotech Limited'. The defacto complainant, who is the agent of the said company had collected a huge amount of Rs.1,10,00,000/- from 50 deposit holders on the basis of the false promise given by the petitioners' company as they would give lands equivalent to the deposit amount. But, the petitioners neither repaid the collected https://hcservices.ecourts.gov.in/hcservices/ deposit amount nor gave the land as promised. Hence, the defacto complainant lodged a complaint before the respondent police.

3.The learned counsel appearing for the petitioners would submit that the petitioners have been falsely implicated in this case and they have nothing to do with the alleged offence. However, on instructions, the learned counsel appearing for the petitioners would submit that the petitioners are ready to deposit a sum of Rs.15,81,550/- (Rupees Fifteen Lakhs Eighty one Thousand Five hundred and Fifty only) to the credit of crime number before the concerned Judicial Magistrate, without prejudice to their defence before the trial court. Thereafter, the said amount may be disbursed to the deposit holders in their account number. Hence, he prayed for bail to the petitioners.
5.The learned Additional Public Prosecutor appearing for the respondent police produced a list of depositors, whose deposits have already been matured before this Court and submitted that if the petitioners are ready to deposit a sum of Rs.15,81,550/- (Rupees Fifteen Lakhs Eighty one Thousand Five hundred and Fifty only) to the credit of the crime number before the Judicial Magistrate concerned, this Court may consider the bail application of the petitioners. 6.Considering the facts and circumstances of the case and in order to to show their bona fide, the petitioners have now come forward to deposit a sum of Rs.15,81,550/- (Rupees Fifteen Lakhs Eighty one Thousand Five Hundred and Fifty only) to the credit of the crime number without prejudice to their rights and contentions, this Court is inclined to grant bail to the petitioners.
7.Accordingly, the petitioners are ordered to be released on bail on condition that each of the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each, of whom, one should be a blood related surety, each for a like sum to the satisfaction of the learned Judicial Magistrate, Theni, and on further condition that:
(a) The petitioners shall deposit a sum of Rs.15,81,550/(Rupees Fifteen Lakhs Eighty one Thousand Five Hundred and Fifty only) to the credit of Crime No.4 of 2019, before the Judicial Magistrate concerned before the execution of sureties, without prejudice to their defence before the Trial Court. Thereafter, the said amount shall be disbursed to the deposit holders as mentioned above, within a period of four weeks therefrom.
(b) the sureties shall affix their photographs and left thumb impression in the surety bond and the concerned Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
(c) the petitioners 1, 3 & 4 shall report before the respondent police at 10.30 a.m. until further orders and the second petitioner shall report before the respondent police as and when required;

(e) the petitioners shall not abscond either during investigation or trial;
(f) on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;
(g) if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC;
