This petition has been filed seeking to direct the respondents herein to alter the FIR, in Crime No.13 of 2016 under Section 307 of IPC and to take action against the accused persons based on the complaint of the petitioner dated 05.02.2016.

The learned Government Advocate on instructions would submit that the FIR was registered only on 17.01.2016 for offence under Sections 294(b), 323 and 506(ii) of IPC. The investigation is in progress. If in the course of investigation, the respondent police collected sufficient materials, the offences will be accordingly altered and all the accused persons will be brought to book.

In view of the above submission, there shall be a

direction to the 2nd respondents to continue the investigation effectively and based on the materials collected during the course of investigation, either alter the FIR or file the final report by showing the necessary offences. All the persons involved in the crime shall also be shown as accused persons.
