Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL RC.No.560 of 2019 on the file of the High Court, the High Court will be pleased to pass necessary orders to suspend the execution of sentence and conviction passed by the Learned VIII Metropolitan Magistrate Court, George Town, Chennai in CC No.2318 of 2009 dated 24.05.2011 and confirmed by the Learned 1st Additional District and Sessions Judge, Chennai, in CA No.116 of 2011, dated 17.10.2018 pending disposal of this above CRL RC.No.560 of 2019

Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL RC.No.560 of 2019 on the file of the High Court and upon hearing the arguments of M/S.M.A.SRINIVASAN, Advocate for the petitioner the court made the following order:-

The petitioner has been convicted and sentenced by the Trial Court, which has been confirmed by the Appellate Court.

This Court, by order dated 17.06.2019 directed the petitioner to surrender before the Trial Court and adjourned the case to 24.06.2019. On 24.06.2019, there was no representation for the petitioner and the matter was directed to be posted on 25.06.2019 under the caption "For dismissal".

Today, when the matter is taken up for hearing, there is no representation for the petitioner. Hence, this Criminal Miscellaneous Petition is dismissed. It is open to the Trial Court to take the petitioner into custody for serving the sentence.
