Prayer:- This Criminal Appeal is filed u/s.374[2] read with 382 Cr.P.C., to set aside the order of conviction and sentence imposed against the petitionre by the learned Principal Sessions Judge, Special Court, Villupuram by order dated 05.07.2010 in SC.No.138/2009 and acquit the appellant.
JUDGMENT
This Criminal Appeal is filed against the judgment of conviction and sentence, dated 05.07.2010 made in SC.No.138/2009 by the learned Principal Sessions Judge, Special Court, Villupuram. The appellant stood charged and tried for the commission of the offences under sections 498-A and 304[B] IPC and section 3[2][5] of the Scheduled Caste and Scheduled Tribe [Prevention of Atrocities] Act, 1989 and the Trial Court, vide impugned judgment dated 05.07.2010, had acquitted the appellant of the charge levelled against him under section 3[2][5] of the Scheduled Caste and Scheduled Tribe [Prevention of Atrocities] Act, 1989, and however, convicted him under sections 304[B] and 498-A IPC and sentenced him to undergo rigorous imprisonment for
2 years and to pay a fine of Rs.5000/-, in default, to undergo three months simple imprisonment for the offence u/s.498-A IPC and sentenced him to undergo 10 years rigorous imprisonment and to pay a fine of Rs.5000/- with a default sentence of 6 months simple imprisonment for the offence u/s.304[B] IPC.
2 When the matter is taken up today, the learned counsel for the appellant/accused would submit that the appellant/accused passed away on 05.01.2017 and he has also enclosed the certified copy of the death certificate.
3 In view of the death of the appellant/accused, the criminal appeal stands abated as per section 394[1] Cr.P.C.
