Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 477 days in filing petition to restore the appeal in AS(MD) No.153/2008 on the file of this Honourable Court and to pass such other or further orders as this Honourable Court may deem fit and proper in the circumstances of the case and thus render justice.

Prayer in AS(MD). 153/ 2008 :

To Set-aside the Judgment and Decree passed in OS.427/2004 on the file of the Additional District and Sessions Judge, (Fast Track Court.No.III), Madurai and thus render justice.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.M.P.DHAMODARAN, Advocate for the petitioners and of M/S.M.PARAMESWARI, Advocate for MR.S.M.S.JOHNNY BASHA, Advocate on behalf of the Respondent, the court made the following order:-

This petition has been filed by the petitioners/appellants to condone the delay of 477 days in filing the petition to restore the appeal in A.S. (MD) No.153 of 2008.

When the matter is taken up for hearing, the learned counsel appearing for the petitioners seek permission of this Court to https://hcservices.ecourts.gov.in/hcservices/ withdraw the petition and he has also made an endorsement to that effect in the Court bundle.

In view of the same, this Civil Miscellaneous Petition is dismissed as withdrawn.
