PRAYER: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus to call for the impugned proceedings in e.f.vz;.q12/11468/2016 dated 29.04.2016 of the first respondent and to quash the same and consequently direct the respondents to issue appointment to the petitioner as per the Resolution No.7 dated 15.09.2011 passed by the fourth respondent.

Heard the learned counsel for the parties.
2.The issue relates to filling up of the vacancy in the post of Panchayat Clerk in Narasinganallur Panchayat. The case of the petitioner for being appointed to the said post was rejected on the ground that there is no vacancy. https://hcservices.ecourts.gov.in/hcservices/

3.When the matter was taken up for hearing, it was submitted by the learned counsel on either side that the said post is presently vacant. It is for the third and fourth respondents to take steps to fill up the said post. Since it is a public post, all eligible persons are entitled to apply for consideration of their applications. If the said vacancy is filled up, the petitioner's case of course shall also be considered along with all other eligible candidates, if he takes out an application.
4.Directing the respondents to consider case of the petitioner while filling up the said post, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
