Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of mandamus directing the respondents to take appropriate action on the representations of the petitioner dated 9.5.2018 seeking to relocate the liquor shops/arrack shops at Parikalpet Road area Bahour Commune Panchayat Puducherry and forbearing the respondents from granting license to any fresh IMFL shop both wholesale, retail or shifting or permitting any wine shop owners to run the Wine Shops in Parikalpet Road leading to villages in the light of the Judgment of Honourable Supreme Court of India very particularly in Parikalpet area ECR Road, Bahour Commune Panchayat and also order issued by the Chief Secretary Government of Puducherry, Puducherry in No.8532/CS/2002 dated 5.12.2002.

The grievance made by the petitioner, representing General Public and Residents of Krishnavaram Mathikrishnavaram Kanniakoil Bahour Commune Puducherry Rep. by one N.Ramalingam is that the representation and the complaint filed against the Liquor Shops located in Bahour Commune has not been heard and disposed of by the Competent Authority under the Excise Act.

The representation dated 9.5.2018 is addressed to the Lieutinent Governor, Union Territory of Puducherry, the Chief Secretary to Government, Government of Puducherry and the District Collector, Puducherry.

Having heard the learned counsel for the petitioner, we are of the opinion that this petition can be disposed of by directing the Competent Authority viz., Respondent No.2, the District Collector, Puducherry to give an opportunity to the Representative of the Petitioner to putforth his grievance and decide the representation in accordance with law, within a period of three weeks from today. The petitioner shall appear before the said Authority on 24.12.2018, without any separate notice.

The writ petition is disposed of accordingly. No costs. The connected miscellaneous petition is closed.
