Application praying that this Hon'ble Court be pleased to pass an order of summary judgment in C.S.No.996 of 2017 and consequently, decree C.S.No.996 of 2017 as prayed for.

This Suit along with Application coming on this day before this court for hearing in the presence of Mr.R.Palaniandavan, Advocate for the Plaintiff in C.S.No.996 of 2017 and for the Applicant in A.No.7026 of 2018, and Mr.Vishnumohan, Advocate for the defendants 1 & 2 in C.S.No.996 of 2017 and for the respondents 1 & 2 in A.No.7026 of 2018 and Mr.Thriyambak J.Kannan, Advocate for the 3rd defendant in C.S.No.996 of 2017 and for the 3rd respondent in A.No.7026 of 2018 and upon reading the plaint filed in C.S.No.996 of 2017 and the judges summons and the affidavit of Sridhar Ramanurthy, and the counter affidavit of S.Prabhakaran, and counter affidavit of Brian Borthwick filed in A.No.7026 of 2018, it is ordered and decreed as follows:-

That 1. Hotel Residency Towers, Represented by its General Manager, Charles Fabian, 2. Appasamy Real Estates Limited, Represented by its Chairman and Managing Director, Mr.Ravi Appaswamy, 3. M/s. Sasha Events, Represented by its https://hcservices.ecourts.gov.in/hcservices/ Proprietor, Gulam Abbas Ali Khan, the defendants herein, their men, agents, servants, assigns, heirs,

representatives, successors, affiliates or any other persons claiming through/under them be and are hereby restrained by an order of permanent injunction from in any manner publicly performing or communicating the suit movie songs, i.e., sound recordings in 151 movies, which have been extracted/reproduced supra, more fully set out in the schedule hereunder.

That if the defendants herein, choose to make any 'on ground performance' qua suit movie songs more fully set out in the schedule hereunder, they shall approach the plaintiff for license and plaintiff herein, shall grant license i.e., copyright on mutually agreed commercial terms and though obvious, it is made clear that this decree shall not come in the way in such a course being adopted.

That the stated position of the defendants herein, that they have not made any 'On Ground Performance' of suit movies songs and have therefore not infringed the copyright of the plaintiff qua suit movie songs in taken on record.

That the injuncture decree in restricted to suit movie songs more fully set out in the schedule hereunder, and that limb of the prayer pertaining to copy right in other work owned by the plaintiff herein, is obviously outside the scope of this decree.

That there shall be no order as to costs of this suit.

That the A.No.7026 of 2018 do stand closed.
