C.S.No.305 of 2017 is preferred, under Order VII Rule 1 CPC read with Order IV Rule 1 of the OS Rules of the Madras High Court, Sections 11,29,134, 135 of Trade Marks Act, 1999, Section 75 of Indian Contract Act, 1872 and Section 10 of Specific Relief Act, 1963 seeking (a) to declare that the franchise business relationship between plaintiffs and defendant Nos.1 to 3 is terminated; (b) to declare that defendant No.3 ceases to be the 'Lessee' in the tripartite lease agreement dated May 01, 2012 with defendant No.3 and Mr.Siddharth Ramachandran (Defendant No.4) in respect of premises situated in Nungambakkam, bearing address at Door No.19, First Floor, 3rd Street, Wallace Garden, Nungambakkam, Chennai-600 006 as defendant Nos.1 to 3 violated the same, (c) to grant permanent injunction restraining the defendant Nos.1 to 3, their directors, franchisees, licensees, employees, officers, servants, agents and all other acting for and on their behalf from accessing and using following social media links consisting older posts and photographs of plaintiff's trademark PAGE3 amounting to infringement of plaintiff's registered trademark under No.2058665
