Prayer: Criminal Original Petition filed under Section 482 Cr.P.C. to call for the records relating in C.C.No.443 of 2017 pending on the file of the Judicial magistrate -V, Coimbatore and quash the same.

The prayer sought for in the present petition is to call for the records in *C.C.No.443 of 2017 pending on the file of the *Learned Judicial Magistrate V, Coimbatore and quash the same.

It is submitted that, pending Criminal Original Petition, the petitioner and the 2^nd respondent/defacto complainant have amicably resolved the dispute between themselves.

Both the learned counsel have identified the de-facto complainant, who is present before this Court today. In order to identify the petitioner and the 2nd respondent, they have submitted the photo copies of their Driving license bearing Nos. TNB11 2017 00006006 and TN72 19930003307 respectively and after verification of the original, the same are recorded.

Today, an Affidavit dated 26.02.2018 was also filed by the 2^nd respondent/defacto complainant to the effect that he has no objection to quash the proceedings in C.C.No.443 of 2017 pending on the file of the Learned Judicial Magistrate V, Coimbatore police.

Recording the same, the proceedings in *C.C.No.443 of 2017 pending on the file of the *Learned Judicial Magistrate V, Coimbatore police is quashed. The Criminal Original Petition is allowed.

The Affidavit filed by the 2^nd respondent/defacto complainant dated 26.02.2018 shall form part of the order.
