4.Mr.Ramesh, learned Senior Counsel representing Mr.T.Mohan, counsel for the petitioner submitted that though the name of the petitioner did not find place in the FIR, she has been arrested and remanded to judicial custody, that too, without any summons. According to the learned Senior Counsel, the petitioner has been discharging her duties as Additional Commissioner (Thiruppani) in HR&CE Department, without any blemished service, however, she has been falsely implicated in this case. Drawing the attention of this Court to the medical certificate issued by a Diabetes Specialities Centre, the learned Senior Counsel submitted that the petitioner is taking treatment for diabetes, for which, she requires domiciliary treatment and regular period check ups on continous basis for life long. Further, relying on various decisions of the Supreme Court produced before this Court in the form of typed set, the learned Senior Counsel submitted that this Court has special power under Section 439 Cr.P.C to consider the case of the petitioner for bail, subject to any conditions that may be imposed by this Court. The learned Senior Counsel also submitted that in similar circumstances, the Madurai Bench of this Court granted bail to the accused in Cr.No.1 of 2018 on the file of the Idol Wing CID, by imposing stringent conditions. Thus, the learned Senior Counsel sought the indulgence of this Court to grant bail to the petitioner.
