made by the Tamil Nadu Public Service Commission. Presently, the petitioner is serving as Agricultural Officer at Devakottai under the control of the Assistant Director of Agriculture, Devakottai, Sivagangai District. During the years 1986 and 1987, some disciplinary proceedings had been initiated against the petitioner for his unauthorised absence or has taken leave, without the sanction of the authority and those proceedings, ultimately ended by completion of litigations initiated by the petitioner. However, the present grievance of the petitioner is that though the petitioner had joined in service in the year 1986, of course, pursuant to the selection of the said Service Commission and the petitioner, though had been working continuously for all these years as Agricultural Officer, his probation has not been so far declared by the 2nd respondent. In order to get his probation declared, the petitioner has already approached the 2nd respondent, who in turn, after having considered the request of the petitioner, had sent the proposals to the Government on 05.07.2012. In the said proposals, the 2nd respondent has given his recommendation that, after the leave period for long time of 6 years, he had again joined duty on 01.09.1993, therefore, within a period of two years, his probation should have been completed and to be declared as such. Therefore, by relaxing Rule 9 of the Tamil Nadu Agricultural Extension Service Special Rules, his probation could have been declared on completion of 2 years, atleast, from the date of rejoining in service. Therefore, finally, the 2nd respondent in the said letter dated 05.07.2012 had recommended to the first respondent Government to declare the probation of the petitioner as on 01.09.1995 by giving necessary relaxation to the relevant Rule.
