PRAYER: Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents 1 to 3 to direct the 4^th respondent to close the bore wells, sunk in violation of the Government Order in G.O.Ms.No.281 dated 03.04.1996, within 20 to 40 feets from the petitioner's existing well in Survey No.1174/14 at Aalvarneri Village, Nanguneri Taluk, Tirunelveli District by considering his representation dated 09.06.2017.

This writ petition has been filed by the petitioner to issue a writ of Mandamus directing the respondents 1 to 3 to consider the petitioner's representation dated 09.06.2017.

The limited prayer in this Writ Petition is to consider the representation of the petitioner dated 09.06.2017, in respect of certain bore wells and sunk which came into existence in violation of G.O.Ms.No.281 dated 03.04.1996.

Without going into the merits of this case, this Court is inclined to direct the respondents 1 to 3 to consider the said representation, after due notice to the petitioner as well as 4^th respondent, for the purpose of implementing the G.O.Ms.No.281 dated 03.04.1996, within a period of six weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the case and the authority concerned is free to deal with the matter on its own merit as per law.

The writ petition is disposed of as above. No costs.
