The prayer in this petition is to forbear the respondents 3 and 4 from interfering with the civil dispute in respect of the property situated in No.106 Mettukulam Koyambedu Village Chennai 600 107 pending between the petitioner and the 5th respondent in C.S.No.24/2017 on the file of this Honourable Court and in O.S.No.5005/2016 on the file of Learned Vth Assistant Judge City Civil Court at Chennai.

2.By consent of both sides, the writ petition is taken up for final disposal at the admission stage itself.

3.Today when the matter is taken up, the Inspector of Police is present. He brought to the notice of this court that as per the direction of this court in W.P.No.2093 of 2017, FIR has been registered against the petitioner in Crime No.329 of 2017 and further, this court in C.S.No.24 of 2017, has granted an order of interim injunction restraining the petitioner from interfering with the possession of the complainant and the same is pending. He further stated that the allegation that the petitioner is harassed is not correct.

4.In view of the above, the respondent police is directed not to harass the petitioner and necessary steps shall be taken only when the petitioner is not cooperating for investigation. The petitioner is willing and ready to cooperate for the investigation and the statement of the petitioner is recorded. The respondent police is further directed to investigate the matter in accordance with law. The writ petition is closed with the above direction. No costs. The connected miscellaneous petition is also closed.
