PRAYER: Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents to implement the 2 Resolution dated 02.05.2017 and 09.5.2017 of Tahsildar of Kanthatchipuram to connect both the water tanks of 30000 litres and 60000 litres capacity by gate wall and to supply uniform water supply to the residents of both Pethankollai Street and other Street, near Murugan temple, Sithathur village, Kandatchipuram Taluk, Villupuram or to erect an additional water tank in the street near Murugan temple to supply sufficient drinking water to 350 families living in this Street.

In sum and substance, the grievance of the petitioner is with respect to supply of water.

In the status report filed by the District Collector, Villupuram/respondent No.1, it has been stated as follows:

“8.Two Peace Committee meetings were conducted by the Tahsildar, Kandachipuram on 02.05.2017 and 09.05.2017 and resolutions were passed (i) to disconnect illegal individual water connections and (ii) to connect both OHTs with gate valves for uniform water supply. As per the resolution passed in the Peace Committee meeting, gate valves have been fixed at required places to supply water to all streets including the elevated area and to the tail end of the village to ensure uniform supply of drinking water to all. With regard to removal of illegal connection, notices were issued to the households having illegal motor connections. On 25.06.2017, 124 illegal connections have been disconnected and 85 motors used by the public to tap water from the mains were also seized. Now daily water supply is given uniformly to all the streets and the Block Development Officer (VP) has been instructed to monitor continuously and ensure uninterrupted water supply in the village.

9.As prayed in the writ petition, provision of gate valves has been made in the main pipe lines leading to both Pethankollai street and other streets near Murugan temple and all illegal motor connections have been disconnected and uniform water supply ensured to the said areas and there is no water scarcity as alleged by the petitioner now.

10.Apart from the above, Administrative Sanction has been accorded to take up water supply works to the tune of Rs.3,74,234/- under 14^th Finance Commission Scheme for bore well and pipe line. Another Over Head Tank with 60,000 litre capacity with bore well at an estimate cost of Rs.14,89,000/- has been sanctioned under General Fund of Mugaiyur Block (Sanction copies enclosed) for future need.

11.It is submitted that uniform water

supply is being provided to the people of Sithathur village by storing water in three Over Head Tanks and by fixing gate valves at required places and additional sources are being created by providing two more bore wells and a 60,000 litre capacity OHT for future need.”

Thus from the above, the respondent authorities are giving regular water supply uniformly to all the streets on daily basis.

The statements made in paragraph Nos.8 to 11 of the status report are taken on record.

In so far as administrative sanction for the Over Head Tank with 60000 litres capacity is concerned, learned Government Pleader (i/c) would submit that endeavour would be made to complete it within a period of nine months from the date of receipt of a copy of this order.

Accordingly, we direct the respondent authorities to complete the aforesaid exercise within a period of nine months from the date of receipt of a copy of this order.

The writ petition is disposed of in terms aforesaid. No costs. Consequently, WMP.No.15434 of 2017 is closed.
