3 In view of the submission and endorsement made by the
learned counsel appearing for the appellant, this writ appeal is dismissed as withdrawn. No costs. Consequently, the connected miscellaneous petition is also dismissed. It is made clear that if any fresh cause of action
arise and if the appellant is so advised and if it is available under law, he
may pursue the same.
