ORDER : The Court Made the following order :-

The petitioner / sole accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 419, 420, 465, 468 and 471 IPC, in Crime No.57 of 2014, on the file of the respondent police, seeks anticipatory bail.

2.The defacto complainant lodged a complaint alleging that the petitioner, who is running a trust, namely Sigaram Trust at Suriya Villai, near V.K.P.Higher Secondary School Kulachal, had borrowed a sum of Rs.1,12,10,489/- from his bank by producing bogus document. However, the loan amount was not repaid and the respondent police registered a complaint against the petitioner.

3.While entertaining the anticipatory bail, this Court on 22.09.2014, directed the petitioner to deposit a sum of Rs.25,00,000/- (Rupees Twenty Five Lakhs Only) to the defacto complainant within a period of four weeks from the date on which the order copy is made ready and further condition to appear before the respondent police as and when required. Today, this case came up before this Court for reporting compliance, whether the petitioner comply with the conditions imposed by this Court or not.

4.The learned counsel appearing for the petitioner would submit that he has not able to contact the petitioner and whether the

conditions are complied with by the petitioner and he has not able to ascertain from the petitioner.

5.The learned Government Advocate (Crl.side) appearing for the state would submit that the petitioner did not comply with the conditions imposed by this Court and he has not deposited a sum of Rs.25,00,000/- as directed by this Court.

6.Considering the facts and circumstances of the case and also considering the submission made by the learned Government Advocate (Crl.side), this Court cancel the interim bail granted by this Court on 22.09.2014 and considering the gravity of offence committed by the petitioner and considering the amount involved in the Crime No.57 of 2014, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this Anticipatory bail petition is dismissed.
