Petition under Section 482 of Cr.P.C to call for the records pertaining to the Criminal Case in CC.No.4/2014 on the file of the Judicial Magistrate NO.I, Madurai and to quash the same with regard to the petitioner.

Order : These petitions coming on for hearing on this day, upon perusing the petitions and affidavits and material papers of the petitions and upon hearing the arguments of Mr.J. ASHOK, Advocate for the petitioner, in Crl.Op4575/2014 and of Mr.D.SADIQ RAJA Advocate for the Petitioner in Crl.Op.6840/2014 and of Mr.K.ANBARASAN, Government Pleader(Crl.Side) on behalf of the state this court made the following order:-

Pursuant to the order passed by this Court in Crl.O.P.(MD) Nos.6840 and 4575 of 2014 dated 03.03.2017, a sum of Rs.18,76,000/has been deposited to the credit of Crl.O.P.(MD) No.6840 of 2014, which the petitioner would be entitled to, as he is the defacto complainant in C.C.No.4 of 2014. The Registry has deposited the said sum of Rs.18,76,000/- in a Fixed Deposit account and that the amount has accrued some interest. Therefore, when the petitioner approached https://hcservices.ecourts.gov.in/hcservices/ the Registry for return of the amount, the Registry has got a doubt as to whether the petitioner should be paid only Rs.18,76,000/- or

he should be paid the said amount along with interest. This doubt has arisen because of the following averments in the joint memo: "The second respondent may be permitted to withdraw an amount of Rs.18,76,000/-deposited by the petitioners to the credit of Crl.O.P.No.6840 of 2014 in the following terms:

Without prejudice to his right to work out his remedy for claim of interest for the above said amount of Rs.18,76,000/-before the Civil Forum."

In the considered opinion of this Court, the above said clause refers to only the earlier claim of interest for Rs.18,76,000/- by the petitioner, this cannot mean that the petitioner will not be entitled to interest that has accrued on Rs.18,76,000/- that has been deposited by the Registry in the Bank.

Hence, the Registry is directed to disburse Rs.18,76,000/together with the accrued interest to the petitioner on proper identification.

Both these petitions are disposed on the above terms.
