from Melakodumalur to Koneriyendal Road to Thatchanendal Road KMO/o-2/6 and the second road work is from Puluthigulam to A.Nedungulam O/o – 2/6 by an order dated 08.02.2010. According to the petitioner as per work order, he has completed the entire work. While so, the first respondent issued a notice dated 24.11.2010 to the petitioner imposing a fine amount of Rs.4,75,632/- for non compliance of work within the agreed time. The first respondent has also passed an order cancelling the contract and confiscating the security amount, therefore, the petitioner has submitted a detailed representation on 24.02.2011, since the said representation was not considered, the petitioner filed a writ petition in W.P(MD)No.5588 of 2011 challenging the order of cancellation of tender and to allow him to complete the work. It is further stated that in the meanwhile, a re-tender was called for and therefore, the petitioner filed another writ petition in W.P(MD)No.7372 of 2011, challenging the re-tender notification. This Court by a common order dated 21.04.2014 disposed of the writ petitions, directing the first respondent to consider the representation of the petitioner and pass appropriate orders. Subsequently, the first respondent allowed the petitioner to complete the balance work and the second respondent paid a sum of Rs.4,48,052/-. In the meanwhile, by an order dated 18.07.2014, the first respondent passed the impugned order imposing a fine amount of Rs.4,75,632/-, after completion of work.
