These applications have been pending from the year 2009 onwards.
2 . A perusal of the papers reveal that the defendants had filed written
statement as early as on 08.11.2010. Pendency of original applications have not enabled either party to lead evidence to establish the case as stated in their respective pleadings.
3. To enable the parties to go to trial or to inform them to come an amicable settlement, without going into the merits of the applications, the applications are closed.
4. It is made clear that the order stating that the said applications are
closed will not in anyway affect the merits of the parties during evidence at the
trial.
