The learned counsel appearing for the revision petitioner has submitted that the revision petitioner is not pressing this Civil Revision Petition as the suit in O.S.No.302 of 2008 came to be dismissed for default on 29.3.2016 and therefore, the Civil Revision Petition may be dismissed as not pressed by granting liberty to file a fresh impleading petition as and when the suit is restored. He has also made an endorsement to that effect.

In view of the above submission and the endorsement made

by the learned counsel appearing for the petitioner, the Civil Revision Petition is dismissed as not pressed granting liberty as sought for. It is needless to mention that if any such petition is filed by the revision petitioner in the aforesaid suit, such petition shall be considered on merits and in accordance with law. The connected Miscellaneous Petition is closed. No order as to costs.
