This Criminal Original Petition has been filed seeking a direction to the second respondent to register an FIR on the basis of the petitioner's complaint dated 05.02.2016 in C.S.R. No.100/16.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

It is represented by the learned Additional Public Prosecutor that the petitioner lodged a complaint with the second respondent police; on the said complaint, the petition enquiry is pending in CSR No.100 of 2016 and the petitioner is not co-operating in the enquiry.

The petitioner is directed to appear before the second respondent police and co-operate in the enquiry and during the course of enquiry, if any cognizable offence is made out, a regular case shall be registered, in accordance with the law laid down by the Honourable Apex Court in Lalita Kumari vs. Govt. of U.P. & others [(2014) 4 SCC 1], otherwise, the petition may be closed under intimation to the petitioner.
