This Court by an order dated 12.08.2013 made in Crl.O.P.No.20287 of 2013, directed the respondent herein to investigate the case in Crime No.278 of 2013 pending on his

file and file a final report as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of that Order. Since the said order has not been complied with till date, the petitioner is https://hcservices.ecourts.gov.in/hcservices/ before this Court with this Contempt Petition.

When the matter is taken up for hearing today, the learned Government Advocate (Crl. Side) submitted that after completion of the investigation, the respondent has filed a Referred Charge Sheet stating as ''mistake of fact'' and therefore, the petitioner has to approach the concerned Magistrate Court for further remedy.

In view of the above, I am of the view that
nothing survives in this Contempt Petition. Accordingly,
the Contempt Petition is closed as infructuous with liberty
to the petitioner to work out her remedy before the
concerned Magistrate Court in the manner known to law.
