Prayer: Petition filed u/sec 24 of CPC to withdraw H.M.O.P. No. 13 of 2014 on the file of Sub Court, Ariyalur and transfer the same to the file of Sub Court, Dharapuram, Tiruppur District.

The wife is the petitioner before this Court seeking transfer of H.M.O.P. No. 13 of 2014 filed by the respondent/husband for divorce before Sub Court, Ariyalur, to the file of Sub Court, Dharapuram, Tiruppur District, on the ground that she is living with her parents in Nathakadaiyur Village, Kangayam Taluk, Tiruppur District.

Heard the parties and perused the records.

Mr.N. Manokaran, learned counsel for the petitioner would submit that it is very difficult for the petitioner to travel from Nathakadaiyur Village to Ariyalur, which is more than 300 Kms, to attend the hearing in H.M.O.P. No. 13 of 2014. Hence, the present petition for transfer.

Learned counsel for the respondent/husband would submit that the respondent is, at present, working in Dubai and he has to come from Dubai to attend the hearing and therefore, he wants the case to be transferred to a place near any city, which has got an international airport.

Considering the convenience of both parties, it is appropriate to transfer H.M.O.P. No. 13 of 2014 pending on the file of Sub Court, Ariyalur to the file of Principal Sub Court, Tiruppur. Accordingly, H.M.O.P. No. 13 of 2014 on the file of Sub Court, Ariyalur is transferred to the file of Principal Sub Court, Tiruppur, for disposal.

The transfer C.M.P. Is disposed of accordingly. No costs. The connected MP is closed.
