Contending inter alia that order dated 17.12.2014 made in W.A.No.839 of 2013 has not been complied with, Mr.A.Arockiasamy, has filed Contempt Petition No.456 of 2015, against the Commissioner of Corporation, Chennai.
2.When the matter came up for hearing on 09.09.2015, after
extracting the statutory provisions, we directed the Commissioner, Corporation of Chennai, to re-lay the roads/streets in Ward No.48, Now Ward No.90, (7th Zone) Corporation of Chennai, Thiruvalleeswarar Nagar, Anna Nagar West, Chennai-40 and directed the Registry to post the matter after two weeks. Subsequently, on 28.09.2015, on the basis of the proceedings dated 25.09.2015 of the Superintending Engineer, Corporation of Chennai, Zone VII, (Ambattur), Mr.R.Arunmozhi, learned counsel for the respondent submitted that technical
sanction has been accorded by the Superintending Engineer, for forming and re-laying the BT Roads.
3.Today, on the basis of the Proceedings No.Ma.A.7 Na.Ka.No.E1/07403/2015, dated 30.09.2015 of the Commissioner,
Corporation of Chennai, learned counsel for the respondent submitted that as per the procedure in vogue, if the estimation
for any developmental work is more than one crore, then the Council's approval is required. He further submitted that for
getting the Council's approval, the file would be circulated to https://hcservices.ecourts.gov.in/hcservices/ the Zonal Officer, Chief Engineer (General) and the Deputy

Commissioner (Works) and thereafter, to the Commissioner of
Corporation, Chennai. According to him, after circulation to
the abovesaid Authorities, proposals for sanction for forming and re-laying the BT Roads, were placed before the Council on 30.09.2015 and vide Resolution No.340/2015, the Council of
Corporation of Chennai, has granted approval for the above project.
4.Learned counsel for the respondent further submitted that whenever the Council has approved the developmental work for which the estimation is above one crore, no administrative order is required to be issued by the Commissioner of Corporation and that the sanction of the Council or passing of the resolution by the Council, as the case may be, itself amounts to administrative sanction. He further added that when the
proposals are approved by the Council, works have to be carried out as per the procedure.

Chennai Corporation, was recorded to the effect that the first respondent Corporartion is not discontinuing the provisions of basic amenities. Therefore, it is made clear herein that the first respondent Corporation is bound to continue the provisions of the basic amenities to the residents, until further orders. This order will not preclude the Temple from claiming arrears of lease amount or the disputed amount payable by the tenants/subtenants.

to state that work has to be commenced at the earliest and roads have to be re-laid.
Learned counsel for the respondent submitted that as on date, there is a huge arrears of tax to be paid by the members
of the Society. It is open to the Corporation of Chennai, to take appropriate measures. We sincerely hope that Nr.N.Rajan would advise the members of the Society, Thiruvalleeswarar Nagar, to honour the statements made before this Court.
