Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to take action to remove the encroachment in the Raja Vaikkal running in Samberi area and the irrigation channel with a specific direction to restore the irrigation channel desilting the same so as to enable the ayakatdars to get the benefit of water irrigation in Survey Nos.462/7 and 460/10 in Kattukottai village, Attur Taluk, Salem District, within a time frame.

The petitioner, through this Public Interest Litigation, seeks action to remove the encroachments in Raja Vaikal running in Samberi area and the irrigation channel with the specific direction to restore the irrigation channel by de-silting the same so as to enable the ayakatdars to get the benefit of water irrigation in Survey Nos.462/7 and 460/10 in Kattukottai Village, Attur Taluk, Salem District.

2.In respect to the aforesaid, the petitioner has made various representations commencing from 2.5.2014 to the last one on 26.9.2014. In pursuance to the same, the Public Works Department, Irrigation Section/sixth respondent has called upon the Tahsildar/third respondent to submit details of encroachments in Form I. It appears that the same has not elicited any response, with the result, no action has been taken.

3.We thus call upon the third respondent to send the requisite information to the sixth respondent in Form I within 15 days of receipt of this order and thereafter, call upon the sixth respondent to take action in accordance with law with notice to all concerned, more specifically respondent Nos.7 to 19, in case encroachments are found.

4.The writ petition accordingly stands disposed of. No costs. Consequently, connected MP stands closed.
