2.The case of the petitioner is that a large extent of 0.79 acres in Plot M No.21F (North Phase) in the Developed Plots Estate at Ambattur was assigned by the third respondent in favour of M/s.Umayal Packing and Agencies Private Ltd., vide sale deed dated 14.12.1973 under document No.3081 of 1973 on the file of the Sub-Registrar, Madras North. The said assignment was reassigned by order dated 17.2.1981, by a registered deed of assignment dated 30.4.1981 in Document No.2177 of 1981, in favour of M/s.Fabridges, where one Rajarathinam and others were partners. The said Rajarathinam and M/s.Fabridges have sold the same to one M/s.First in Fashions Exports (P) Ltd., vide registered document No.1040 of 1992, in the Office of the Sub-Registrar of Ambattur and patta and revenue records were also changed in their name. 0.39.5 cents of the above said land was purchased by M/s.Stainz Away Dry Cleaners (Pvt.) Ltd., under a registered sale deed dated 11.6.2001, vide document No.2919 of 2001 on the file of the Sub-Registrar, Ambattur from the above said M/s.First in Fashions Exports (P) Ltd. The remaining portion being 0.39.5 cents of an extent of 0.79 acres was purchased by one M/s.Kanmaran Exports (P) Ltd., by virtue of sale deed bearing Document No.4223 of 2001 and the petitioner purchased 39.5 cents (17213 sq. ft.) of land together with 3500 sq. ft. of building with A.C.C. Sheet Roofing from the said M/s.Stainz Away Dry Cleaners (Pvt) Ltd., vide document No.13962 of 2006 dated 8.12.2006 and in toto, the petitioner has purchased 20461 sq. ft. of land with 3500 sq. ft. of building. After the purchase, in January, 2013, he approached the respondents 1 and 2 for demolition and reconstruction and for according planning permission for the proposed construction in the said property. However, the respondents 1 and 2 insisted the petitioner to produce NOC from the third respondent for entertaining the application. According to the petitioner, the application submitted was refused to be received.
