Today, this matter is posted under the caption 'For Being Mentioned'.

2.This Court, by order dated 20.01.2015, has allowed the Original Petition No.271 of 2013 by granting Letters of Administration in favour of the petitioner in OP and dismissed the TOS.No.25 of 2013 since the petitioner in TOS made an endorsement that he is withdrawing the TOS. At the time of the withdrawal of TOS, though the learned counsel for the petitioner in TOS sought for a direction to the Registry to refund the Court fee, this Court has not passed any order with regard to refund of Court fee. Hence, the matter is brought before this Court today under the caption 'For Being Mentioned'.

3.Considering the submissions made on either side, this Court passes the following order_

“ Registry is directed to refund the Court fee to the petitioner in TOS in accordance with the Rules ”.

Registry is directed to add the above direction as Clause (iv) in the result of the order dated 20.01.2015 and issued fresh order copy to the parties.
