PRAYER : Plaint under Order IV Rule 1 of O.S. Rules r/w. Order VII Rule 1 of C.P.C. praying for (a) passing a preliminary decree for partition and separate possession of the plaintiff's share in the suit properties mentioned in the 'A', 'B' and 'C' Schedules in the plaint by allotting 1/4^th share by metes and bounds in favour of the plaintiff; b)appointing a Commissioner for effecting the division of the suit 'A', 'B' and 'C' Schedule mentioned properties into four equal shares and allot one such share to the plaintiff; c) granting a decree for future mesne profits in respect of 1/4^th share in the suit 'A'schedule mentioned properties from the date of institution of the suit till the date of delivery of the possession and to pay the costs of the suit.

The suit is filed by the plaintiff/mother of the first defendant and grandmother of the defendants 2 and 3 for partition

in the suit schedule properties of her 1/4^th share. It is represented that the parties have amicably settled the matter by themselves. Memo of compromise dated 26.11.2014 has entered into between the plaintiff and defendants is filed and it is duly signed by the parties and counter signed by the learned counsel for the respective parties. The plaintiff as well as the defendants are present before this Court today.

Memo of compromise read over to the parties and they agreed to the terms of memo of compromise. Mode of division is indicated in the memo of compromise and plan is also been attached with the same. Memo of compromise is recorded. In view of the memo of compromise, there shall be a decree in terms of memo of compromise. Memo of compromise along with the annexure namely, sketch shall form part of the decree. Consequently, connected applications are also closed. No costs.
