ORDER : The Court Made the following order :-

The petitioner is A3 and he was arrested and remanded to judicial custody on 11.08.2014 for the alleged offence punishable under sections 379 r/w 467, 468, 471 and 474 of IPC, in Crime No.374 of 2014, on the file of the respondent and hence, seeks bail.

2.The case of the prosecution is that A1 had committed threat of lorry and sold the same to A2, who in-turn, sold the same by getting RC book from A3.

3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submission that only based on confession of A2, the petitioner has been implicated in this case. It is further submitted that the petitioner is not involved in any other case.

4.The learned Government Advocate (Criminal side) submitted that on the basis of the confession of A2, the petitioner has been implicated in this case.

5.Considering the facts and circumstances of the case and also considering the nature of the allegation made against the petitioner, this court is inclined to enlarge the petitioner on bail with certain conditions.

6.Accordingly, the petitioner is ordered to be released on bail, on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Virudhunagar and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders.
