The present appeal has been filed challenging the order dated 10.11.2011 in W.C.No.12 of 2010 passed by the Deputy Commissioner of Labour-II, Chennai, directing the appellant herein to pay compensation of Rs.3,25,987/- to the respondent herein.

2.Today, when the matter is taken up for consideration, it is represented by the learned counsel on either side that the matter has been compromised and both the parties have arrived a settlement at Rs.2,15,000/- and they have also filed a memo to that effect, signed by both the parties and their respective counsel. As per the memo of compromise, the appellant herein agreed to pay a sum of Rs.2,15,000/- and the respondent herein agreed to receive the same.

3.The memo of compromise filed by both the parties is recorded. In view of the above, the Civil Miscellaneous Appeal is ordered in terms of the memo of compromise filed by both the parties. No costs. The memo of compromise shall form a part of

the order. As the entire award has already been deposited before the Court below, the respondent herein is entitled to withdraw a sum of Rs.2,15,000/- and the appellant herein is entitled to withdraw the balance amount.
