PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for the issue of a Writ of Mandamus directing the respondents to refund Rs.12,500/- and Rs.1,00,000/- to the petitioner, which were deposited in the year 2002 and 2006 respectively at the time of tender auction conducted by the second respondent for workshop and yard at Tuticorin Port for maintaining the Boat and operating the Vinch and further directing the respondents to conduct open tender to be held in the month of March 2013.

The petitioner entered into a lease agreement with the third respondent and on the basis of the said lease, he conducted a Workshop and Yard. The petitioner deposited a sum of Rs.1,12,500/- with the second respondent. As per the condition, the said amount would be refunded on completion of three years of lease period. The lease period finally expired during the year 2009. However, the amount deposited by the petitioner was not refunded to him. This made the petitioner to submit a representation before the second respondent on 07.02.2012. Since the said representation was not considered, the petitioner is before this Court.
