In those complaints, certain allegations had been made against the petitioner. A show cause notice was issued to the petitioner in respect of the such allegations and no final order has been passed in the matter. While so, based on the above said two complaints, the petitioner has been now transferred by way of the impugned order. That is why, according to the learned counsel for the petitioner, the impugned order is not an order made on administrative grounds and it has been made only as a punitive measure. The learned counsel would further rely on the decision of the Hon'ble Supreme Court in Somesh Tiwari vs. Union of India and others reported in (2009) 3 MLJ 727 (SC), wherein the Hon'ble Supreme Court has held that if the order of transfer has been made in lieu of punishment, the same is liable to be set aside as the same is wholly illegal. In other words, according to the learned counsel, the order of transfer made by way of public measure without affording an opportunity and without holding an enquiry is violative of principles of natural justice as well as Article 14 of the Constitution of India.
