report of Dr.Pawn Raja or of Mr.M.Gopalswamy. Therefore, the applicant sent a letter on 18.6.2008 to Mr.M.Gopalswamy requesting him to give a copy of the enquiry report. However, Mr.M.Gopalswamy replied stating that he had given a report to the learned Administrator. The learned Administrator has filed a report to this Court on 13.9.2006 stating that Mr.M.Gopalsamy the Retired District Judge, appointed by him as enquiry officer could not proceed with the enquiry due to his ill-health. Therefore, a new enquiry officer, Mr.K.Manoharan, a Retired Sub Judge was appointed to complete the enquiry and to give his findings within a time frame. But in the complaint given by the applicants on 14.09.2005, they have stated that Mr.N.Kanniah took away all the records, vouchers, etc. with the assistance of Mr.V.S.Kumar. Whereas nothing has been stated by the learned Administrator about taking away of the records and the vouchers by Mr.N.Kanniah assisted by Mr.V.S.Kumar. Hence, the applicant reasonably apprehends that the enquiry officer appointed now, would not be able to conduct the enquiry fairly. Therefore, the applicant apprehends that the conduct of the enquiry will not be fair and more so, the frequent change of enquiry officers by the learned Administrator would also prejudice the rights of the applicants. Hence, the above application for the aforesaid prayer.
