PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C.

ORDER : The Court Made the following order :- Heard both sides.

The petitioner apprehend arrest at the hands of the respondent police for the alleged commission of offence punishable under Sections 420 and 506(I) of IPC in and seeks anticipatory bail.

The learned counsel appearing for the petitioner would submit that the petitioner is arrayed as A2 and A1 has already been arrested and enlarged on bail and A3 has obtained anticipatory bail. The petitioner is only introduced one Sabeer Ali who belongs to Bangalore, for getting job at Canada and the petitioner is nothing to do with the job rocketing and he has not received any amount. Now, the petitioner apprehended arrest. Hence, the petitioner has come forward with this application for anticipatory bail.

Resisting the same, the learned Government Advocate (Criminal side) would submit that the petitioner has received a sum of Rs.3,50,000/- from the defacto complainant for sending the son of the defacto complainant to Canada for job. A1 was already arrested and enlarged on bail and A3 obtained anticipatory bail.

Considering the rival submissions made by both sides and also considering the fact that A1 was already arrested and enlarged on bail and A3 obtained anticipatory bail and even though, the petitioner was https://hcservices.ecourts.gov.in/hcservices/ not arrested neither he interfered with the investigation nor absconded from the jurisdiction, I am inclined to grant anticipatory bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate cum District Munsif Court, Ilayankudi, Sivagangai District and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall report before the court concerned daily at 10.30 a.m. until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C., scrupulously.

The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
