ORDER : The Court Made the following order :-

The petitioners/Accused Nos.1 to 5, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Section 417 I.P.C. and Section 4 of Dowry Prohibition Act in Crime No.63 of 2013, on the file of the respondent police, seek anticipatory bail.

The case of the prosecution is that the betrothal between one Shree Lekha, daughter of defacto complainant and the 1st petitioner herein was solemnized on 15.10.2012 in the presence of the elders of both families and thereafter the petitioners have demanded more dowries to solemnize the marriage.

The learned counsel for the petitioners would submit that the defacto complainant and his daughter tortured the 1st petitioner to come out from his family after the marriage. Since the 1st petitioner did not agree with their conditions, the defacto complainant gave a false complaint against the 1st petitioner and his family members.

The learned Government Advocate (Criminal side) would submit that the matter was referred to Mediation and Conciliation Centre but the same has failed.

On consideration of the facts and circumstances of the case and the submissions made, I am of the view that the petitioners can be granted the relief prayed for and accordingly;

(a) In the event of arrest by or on appearance before the respondent police;

¶20

(b) In the event of appearance before the learned Judicial Magistrate No.VI, Madurai within 15 days from the date of receipt of copy of the https://hcservices.ecourts.gov.in/hcservices/ order,

(i) the petitioners shall be enlarged on bail on their executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand Only) with two sureties each for the like sum to their satisfaction;

the petitioners shall report before the respondent police as and when required for interrogation.
