M.80 motorcycle, bearing Registration No.TN-72-J-9583, as pillion rider and one Mr.S.Ramesh has driven the above said motorcycle. When the above said motorcycle was coming near the office of the Revenue Inspector, Palayamkottai, from east to west, the appellants'/respondents' vehicle viz., Mahindra & Mahindra Jeep, bearing Registration No.TN-07-G-1902, which was driven by its driver in a rash and negligent manner in terrific speed and without observing the traffic rules and regulations of the road, come from south to north and dashed against the said motorcycle. In the above said accident, the claimant has sustained grievous injuries in the left leg and immediately, he was admitted in TVMC Hospital, Tirunelveli and taken first aid treatment and thereafter, he was admitted in Karthick Nursing Home, Perumalpuram, as inpatient from 06.04.2011 to 13.04.2011. Thereafter, he took private treatment, as outpatient till the date of filing the claim petition. The accident was occurred only due to the rash and negligent driving of the driver of the appellants'/ respondents' Jeep and a criminal case was also registered as against the driver of the Jeep in Crime No.103 of 2011 under Sections 294 and 338 IPC and the said criminal case is pending before the Judicial Magistrate Court No.I, Tirunelveli. The age of the claimant was 23, at the time of the accident. He was working as A.C. and Fridge Mechanic in Suns Electronics, Palayamkottai and earned Rs.12,000/- per month. Due to the injuries sustained in the above said accident, the claimant is permanently disabled. Therefore, he sought for compensation of Rs.7,00,000/- with interest at 12 % per annum, from the appellants/respondents.
