2.According to the petitioner, on 04.07.2011, one Mr.G.Kalaimani, who was working as Record Clerk in the third respondent Panchayat, has been promoted as Junior Assistant and transfered to another Panchayat and consequently, a vacancy has arisen in the abovesaid post and that the petitioner was given additional charge of Record Clerk, vide the proceedings of the third respondent, dated 11.07.2011, in R.C.No.127/11. According to the petitioner, last grade servants in the Town Panchayats, like, Water Assistant, Water Supply Watchman, Night Watchman, Motor Operator and Over Head Tank Operator, are eligible to be considered for promotion to the post of Record Clerk and that the Inspector of Panchayat is having the power to promote them, to any suitable post in Panchayat. According to the petitioner, he is also one such last grade servant, working in the third respondent Panchayat and currently holding additional charge of Record Clerk. In view of the vacancy available in the Panchayat, the petitioner gave a representation to the Executive Officer, third respondent Panchayat on 07.07.2011 and requested to be promoted as Record Clerk.
