To Collector, Quilon and Others (AIR 1975 SC 2135 : (1976) 1 SCC 70) if the petitioners are to succeed they must first demonstrate total absence of jurisdiction to proceed on the part of the respondents. Therefore, in the considered view of this Court the above batch of writ petitions seeking issue of writ of mandamus forbearing the respondents from passing orders of detention under Section 3(1) of the Prevention of Black Marketing and Maintenance of Supply of Essential Commodities Act, 1980 are not maintainable. The writ petitions are premature and not maintainable and accordingly the above batch of writ petitions stand dismissed." 15.
