This is first application filed by the applicant/accused under Section 439 of Cr.P.C for grant of bail, who has been arrested on 14/12/2017 by Police Station Amarwara, District Chhindwara in connection with Crime No.800/17 registered for the offence punishable under Sections 120-B, 429 of IPC, u/s 3/7 of the E.C.Act, 4,6,6(A,B), 9(1-2) of the M.P. Govansh Wadh Pratished Adhiniyam, u/s 11(1)(A)(D)(F)(F), 11(2) of the Prevention of Cruelty to Animals Act, rule 49(A), 17(A), 47(B, C), 48, 54(1,2,3), 50 of the Pashu Parivahan Ke Niyam of M.P.Govansh Pratished Adhiniyam, Rule 3, 3(1,2,3) Rule 22 of Prevention of Cruelty to Animals Act (Pashudhan Bazar Viniyam), u/s 39, 66/192, 91/123, 119, 130(1,2,3)/177 of the M.V.Act. It is submitted on behalf of the applicants that co-accused Arban Khna and Farid Khan have been enlarged on bail by this Court vide order dated 12/1/2018 passed in M.Cr.C.No.982/18. The allegations against the applicants are similar to the co-accused persona, who have been enlarged on bail. Charge-sheet has been filed and the trial will take time to conclude. Hence, on the ground of parity, the applicants be released on bail. Learned G.A. opposed the prayer for grant of bail and prayed for its rejection. Having considered the contentions of the learned counsel for the parties and on perusal of the case diary, it is evident that the applicants are in custody since 14.12.2017, offences are triable by Judicial Magistrate, there are no criminal antecedents of the applicants and similarly placed coaccused persons have already been enlarged on bail, this application is allowed. It is directed that applicants Arban Khan and Farid Khan be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each with a solvent surety each in the like amount to the satisfaction of the trial court for securing their presence before the said Court on all the dates of hearing fixed in this regard during trial and for complying with the conditions enumerated in sub-section (3) of Section 437 of Cr.P.C.
