Notification under the Punjab Brewery Rules, 1956.

EXTRACT FROM HARYANA GOVERNMENT GAZETTE EXTRAORDINARY DATED THE 10 TH JUNE, 2022 HARYANA GOVERNMENT EXCISE AND TAXATION DEPARTMENT Notification The 10 th June, 2022 No.27/X-1/P.A.1/1914/Ss.21 and 59/2022.- In exercise of the powers conferred under sections 21 and 59 of the Haryana Excise Act, 1914 (Punjab Act 1 of 1914), and with reference to Haryana Government, Excise and Taxation Department, notification No.09/X-1/P.A.1/1914/S.9/2020, dated the 28 th January, 2020, I, Shekhar Vidyarthi, Excise Commissioner, Haryana, hereby make the following rules further to amend the Punjab Brewery Rules, 1956, in their application to the State of Haryana, with effect from the 12 th day of June, 2022, namely :- 1. These rules may be called the Punjab Brewery (Haryana Amendment) Rules, 2022. 2. In the Punjab Brewery Rules, 1956 (hereinafter called to as the said rules), after rule 15, the following rule shall be inserted, namely:- “15A. The licensee shall installed an integrated CCTV mechanism in his brewery at the main gate, in the bottling rooms, fermenting room and loading of bottled beer and all other important places within the Brewery enclosure to monitor the manufacturing and bottling operations and dispatches of beer. 15B. (1) integrated CCTV mechanism established under rule 15A shall be installed in all the Breweries of the State and a control room shall be set up at the Head Office for receiving live feed from the Breweries which shall generate online MIS and shall be an efficient method to plug leakage of non-duty paid beer in the State. (2) The live feed from such CCTV Camera shall be made available to the Deputy Excise and Taxation Commissioner (Excise) who shall monitor the working of CCTV cameras on fortnightly basis and shall periodically review the live feed and shall recommend the penal proceedings in case any violation is found. The distillery shall make available the CCTV footage, in an electronic format every month, to the office of the Collector.”. 3. In the said rules, in rule 40,- (i) for the sign “.” existing at the end, the sign “:” shall be substituted; (ii) the following proviso shall be added, namely:- “Provided that the licensee shall submit the certificate that the beer produced in his manufactory is fit for human consumption till ten months from the date of bottling, the shelf life for such brand shall be approved for nine months.”. 4. In the said rules, after rule 41, the following rule shall be inserted, namely:- “42 (i) The general operation of the brewery shall be allowed for 8:00 hours in a working day which can be extended by 8:00 hours (second shift) by a brewery on an additional fee of ₹10,000/- and further for 8:00 hours (third shift ) on payment of ₹10,000/- with the prior permission of Excise Commissioner. (ii) The hours of operation for dispatches from brewery shall be limited from 9:00 hours to 19:00 hours and if any brewery licensee if found dispatching liquor beyond the prescribed hours, a penalty of ₹1,00,000/- shall be imposed on the first offense, ₹2,50,000/- on second offence and ₹5,00,000/- for third offence and further on any subsequent offence, the license shall be cancelled.”.
