EXTRAORDINARY PUBLISHED BY AUTHORITY No. 493] NEW DELHI, MONDAY, JULY 11, 2022/ASHADHA 20, 1944 MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION New Delhi, the 11th July, 2022 G.S.R. 531(E).—In exercise of the powers conferred by sub-section (9) of section 11 read with the clause (f) of sub-section (2) of section 25 of the Commission for Air Quality Management in National Capital Region and Adjoining Areas Act, 2021 (29 of 2021), the Central Government, in consultation with the Commission for Air Quality Management in National Capital Region and Adjoining Areas, hereby makes the following rules regulating the method of recruitment, salaries, allowances and conditions of service of the officers and other staff of the Commission, namely:- 1. Short title and commencement.- (1) These rules may be called the Commission for Air Quality Management in National Capital Region and Adjoining Areas (salaries, allowances and conditions of service of the officers and staff of the Commission) Rules, 2022. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.— (1) In these rules, unless the context otherwise requires,- (a) "Act" means the Commission for Air Quality Management in National Capital Region and Adjoining Areas Act, 2021 (29 of 2021); (b) “Commission” means the Commission for Air Quality Management in National Capital Region and Adjoining Areas; (c) “Schedule” means a Schedule annexed to these rules. (2) Words and expressions used herein and not defined in these rules but defined in the Act shall have the same meanings as assigned to them in the Act. 3. Number, salaries and allowances of the officers and staff of the Commission.- The number, salaries and allowances of the officers and other staff of the Commission and their method of recruitment shall be as specified in the Schedule. 4. Number of posts, classification and level in the pay matrix.– The number of posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of the Schedule. 5. Method of recruitment, age-limit, qualifications, etc.– The method of recruitment, age-limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the Schedule. 6. Disqualification. - No person, – (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post: Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 7. Appointing Authority.— The Chairperson of the Commission shall be the appointing authority for the officers and staff of the Commission. 8. Procedure for screening in case of direct recruitment.— (1) The procedure for screening in case of direct recruitment shall be following, namely:- (a) the Commission shall invite applications for the post through an advertisement; (b) all such applications received shall be screened for eligibility by a screening committee constituted by the Chairperson; (c) (i) the screening committee for posts of level-9 and above shall consist of: 1. Member-Secretary – Chairman; 2. Director – Member; 3. Deputy Secretary – Member. (ii) the screening committee for posts of level-8 and below shall consist of: 1. Director – Chairman; 2. Deputy Secretary – Member; 3. Under Secretary – Member. (2) Absence of any of the member of the screening committee shall not invalidate the proceedings of the screening committee. 9. Procedure for screening in case of appointment by deputation.— (1) The procedure for screening in case of appointment by deputation shall be following, namely:- (a) the Commission shall invite applications for the vacant posts through an advertisement on all India basis; (b) the applications received shall be screened for eligibility by a screening committee constituted by the Chairperson; (c) (i) the screening committee for posts of level-9 and above shall consist of: 1. Member-Secretary – Chairman; 2. Director – Member; 3. Deputy Secretary – Member. (ii) the screening committee for posts of level-8 and below shall consist of: 1. Director – Chairman; 2. Deputy Secretary – Member; 3. Under Secretary – Member. (2) Absence of any of the member of the screening committee shall not invalidate the proceedings of the screening committee. 10. Period of deputation.— (1) The period of deputation including the period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall be three years from the date of beginning of the deputation and the period of deputation may be extended upto five years with the approval of the Chairperson of the Commission, and beyond five years and upto seven years with the approval of the Minister for Ministry of Environment, Forest and Climate Change. (2) The instructions on deputation issued, from time to time, by the Department of Personnel and Training shall be applicable to officers and staff serving on deputation basis. 11. Conditions of service.— (1) The conditions of service of the officers and staff of the Commission in matters of pay, joining time, joining time pay, allowances, leave, provident fund, age of superannuation, travelling allowance and leave travel concession, and retirement benefits, and other conditions of service, shall be regulated in accordance with such rules and regulations as are for the time being applicable to the employees belonging to the corresponding level in the pay matrix of the Central Government. (2) Notwithstanding anything contained in sub-rule (1), prior approval of the Chairperson of the Commission or any other Member of the Commission authorised by the Chairperson in this behalf shall be required for official visits abroad to be undertaken by officers and staff of the Commission. (3) The officers and staff of the Commission not allotted accommodation shall be eligible for house rent allowance as admissible to officers and employees of the Central Government drawing similar pay. (4) The officers and staff of the Commission who are on deputation and having Government residential accommodation under general pool shall be eligible to retain Government residential accommodation. (5) (i) the officers and staff of the Commission appointed on deputation, shall continue to be governed by Provident Fund Schemes as are applicable to them in their parent Ministry or Department or Organisation; (ii) the Commission shall recover contribution towards provident fund from such officers and staff and remit the amount immediately to the lending Ministry or Department or organisation; (iii) any loss of interest on account of late remittance shall be borne by the Commission. (6) The officers and staff of the Commission other than those on deputation shall be entitled Group Insurance as per the scheme to be formulated by the Commission in consultation with the Central Government: Provided that in the case of the officers and staff of the Commission appointed on deputation shall continue to be governed by the Group Insurance Schemes as are applicable to them in their parent Ministry or Department or Organisation. (7) (i) the Commission shall recover contribution towards the insurance schemes from such officers and staff and remit the amount immediately to the lending Ministry or Department or Organisation; (ii) any loss of interest on account of late remittance shall be borne by the Commission. (8) The officers and staff of the Commission who are not on deputation shall be governed by the National Pension System. (9) The officers and staff of the Commission who are on deputation shall be eligible for pension and retirement benefits, if any, as are available to them in their parent Ministry or Department or Organisation. (10) The Central Services (Medical Attendance) Rules, 1944 shall apply to the officers and staff of the Commission. 12. Residuary provision.- Matters relating to the terms and conditions of service of the officers and staff of the Commission with respect to which no express provision has been made in these rules or such provisions have not been made by the Central Government, shall be referred by the Commission to the Central Government for its decision. 13. Saving.– Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the ex- servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard. 14. Powers to relax.— Where the Central Government in consultation with the Commission, is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
