Short Title and Commencement.— (1) These rules may be called the Debts Recovery Appellate Tribunal, Allahabad and Debts Recovery Tribunals at, Allahabad, Ranchi, Jabalpur, Patna, Lucknow and Dehradun Recruitment Rules, 2018. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Grade and strength.—The various grades and the number of posts in each grade in Debts Recovery Appellate Tribunal, Allahabad and each Debts Recovery Tribunal under its jurisdiction are as specified in the First Schedule annexed hereto. 3. Number of post, classification and Level in the pay matrix.—The number of post, its classification and level in the pay matrix attached thereto shall be as specified in columns (2) to (4) of Second Schedule . 4. Method of recruitment, age limit, qualifications etc.—The method of recruitment, age limit, qualifications and other matters related to the said post shall be specified in columns (5) to (13) of the Second Schedule . 5. Appointing Authority.—The Appointing Authority in respect of the post specified under column (2) of the Third Schedule shall be the authority specified in the corresponding entry under column (3) of the said Schedule. 6. Disciplinary and Appellate Authorities.—The Disciplinary and Appellate Authorities shall be as specified in the Fourth Schedule attached hereto. 7. Transfer.—Every person appointed to the post in Debts Recovery Appellate Tribunal, Allahabad, and Debts Recovery Tribunals under its jurisdiction is liable to be transferred within the jurisdiction of the Debts Recovery Appellate Tribunal, Allahabad. Provided that an officer appointed on deputation basis or against encadred posts are not liable to be transferred. 8. Seniority.— (1) A common seniority list shall be maintained for each grade for the Debts Recovery Appellate Tribunal, Allahabad and all the Debts Recovery Tribunals under its jurisdiction. (2)The seniority shall be fixed as per the orders issued by the Central Government in the Ministry of Personnel, Public Grievances and Pension, Department of Personnel and Training from time to time in this regard. 9. Disqualifications:- No person.— (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any other person shall be eligible for appointment to the said posts; Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 10. Power to relax - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons. 11. Saving - Nothing in these rules shall affect reservations, relaxation of age limit and other concession required to be provided for the Scheduled Castes, the Scheduled Tribes, the other Backward Classes, ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
